D\u2019autre part, les parcours professionnels que les utilisateurs affichent sur des r\u00e9seaux sociaux professionnels comme LinkedIn, Xing ou Viadeo, et qui sont de plus en plus utilis\u00e9s par les recruteurs au lieu des CV habituels, sont souvent bien moins exactes.<\/p>\n<\/div><div class=\"fusion-text fusion-text-2\"><p style=\"text-align: justify;\">Le pr\u00e9sent article aura pour objet la qualification de ces cas de \u00ab mensonge \u00bb et la pr\u00e9sentation des cons\u00e9quences possibles de tels actes pour leurs auteurs dans le cadre d\u2019une proc\u00e9dure de recrutement. L\u2019article rappellera n\u00e9anmoins qu\u2019il peut facilement y avoir confusion entre malhonn\u00eatet\u00e9 et inconscience de la part des candidats et qu\u2019une proc\u00e9dure de validation de donn\u00e9es s\u2019imposera dans ces cas.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-1 sep-underline sep-solid fusion-title-text fusion-title-size-one\" style=\"--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:20px;--awb-margin-left-small:0px;\"><h1 class=\"fusion-title-heading title-heading-left fusion-responsive-typography-calculated\" style=\"margin:0;--fontSize:49;line-height:1.1;\"><h4>Droits et devoirs<\/h4><\/h1><\/div><div class=\"fusion-text fusion-text-3\"><p style=\"text-align: justify;\">Les futurs employ\u00e9s b\u00e9n\u00e9ficient d\u2019un cadre l\u00e9gal efficace qui vise \u00e0 prot\u00e9ger leurs donn\u00e9es personnelles et priv\u00e9es face aux abus de leurs employeurs potentiels lors du processus d\u2019embauche. Parall\u00e8lement \u00e0 ces droits, toutefois, il incombe aux candidats de respecter plusieurs obligations lors de cette phase cruciale de la vie professionnelle qu\u2019est le recrutement.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-2 sep-underline sep-solid fusion-title-text fusion-title-size-one\" style=\"--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:20px;--awb-margin-left-small:0px;\"><h1 class=\"fusion-title-heading title-heading-left fusion-responsive-typography-calculated\" style=\"margin:0;--fontSize:49;line-height:1.1;\"><h4>Cas de mensonges<\/h4><\/h1><\/div><div class=\"fusion-text fusion-text-4\"><p style=\"text-align: justify;\">Avant de parler des mensonges \u00ab prohib\u00e9s \u00bb, rappelons que dans certaines circonstances, un \u00ab droit au mensonge \u00bb peut \u00eatre reconnu aux candidats. A titre d\u2019exemple, une candidate aurait le droit de mentir si le recruteur lui posait des questions relatives \u00e0 une \u00e9ventuelle grossesse, puisque cela n\u2019a en principe aucune pertinence professionnelle.<\/p>\n<\/div><div class=\"fusion-text fusion-text-5\"><p style=\"text-align: justify;\">Hormis les cas de ce type, le mensonge lors du processus de recrutement est un acte susceptible d\u2019avoir des cons\u00e9quences tant sur les plans civil que p\u00e9nal. Par rapport au contrat de travail tout d\u2019abord, la transmission d\u2019informations erron\u00e9es par le futur employ\u00e9 l\u2019expose au risque de voir sa candidature refus\u00e9e ou son contrat de travail r\u00e9sili\u00e9. Le Tribunal f\u00e9d\u00e9ral a ainsi admis un licenciement avec effet imm\u00e9diat dans son arr\u00eat 4A.569\/2011 du 14 f\u00e9vrier 2011, dans lequel un employ\u00e9 de banque avait menti sur ses responsabilit\u00e9s aupr\u00e8s de son employeur pr\u00e9c\u00e9dent ainsi que sur le montant de sa r\u00e9mun\u00e9ration ; ces mensonges lui avaient permis d\u2019\u00eatre engag\u00e9 en tant que cadre, profitant de responsabilit\u00e9 et d\u2019un salaire nettement sur\u00e9valu\u00e9s vis-\u00e0-vis de ses comp\u00e9tences r\u00e9elles.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-3 sep-underline sep-solid fusion-title-text fusion-title-size-one\" style=\"--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:20px;--awb-margin-left-small:0px;\"><h1 class=\"fusion-title-heading title-heading-left fusion-responsive-typography-calculated\" style=\"margin:0;--fontSize:49;line-height:1.1;\"><h4>Fondements l\u00e9gaux et cons\u00e9quences juridiques<\/h4><\/h1><\/div><div class=\"fusion-text fusion-text-6\"><p style=\"text-align: justify;\">En effet, la bonne foi (cf. art. 2 al. 1 CC) commande aux parties n\u00e9gociant un contrat de ne pas se mettre mutuellement dans l\u2019erreur. Dans le cas concret d\u2019une proc\u00e9dure d\u2019embauche, le respect de la bonne foi impose aux candidats de r\u00e9pondre conform\u00e9ment \u00e0 la v\u00e9rit\u00e9 \u00e0 toute question licite et pertinente. D\u2019\u00e9ventuelles violations de ce principe correspondent \u00e0 l\u2019institution de la culpa in contrahendo, aussi nomm\u00e9e violation des devoirs pr\u00e9contractuels. Cette construction jurisprudentielle peut entra\u00eener des pr\u00e9tentions p\u00e9cuniaires pour le recruteur l\u00e9s\u00e9, s\u2019il a perdu de l\u2019argent en raison de ces mensonges. Une \u00e9ventuelle r\u00e9siliation du contrat de travail se baserait quant \u00e0 elle sur les art. 23 ss CO, traitant du vice de consentement, ainsi que sur les articles traitant du licenciement en mati\u00e8re de droit du travail.<\/p>\n<\/div><div class=\"fusion-text fusion-text-7\"><p style=\"text-align: justify;\">A l\u2019aune de ces principes l\u00e9gaux, un CV, un profil professionnel sur un r\u00e9seau social contenant des informations fictives ou encore la falsification de dipl\u00f4mes constituent sans aucun doute des cas d\u2019application de cette responsabilit\u00e9 pr\u00e9contractuelle. De surcro\u00eet, un candidat ayant transmis de tels documents s\u2019expose \u00e0 de possibles poursuites p\u00e9nales, bas\u00e9es notamment sur l\u2019art. 251 CP, r\u00e9primant le faux dans les titres.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-4 sep-underline sep-solid fusion-title-text fusion-title-size-one\" style=\"--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:20px;--awb-margin-left-small:0px;\"><h1 class=\"fusion-title-heading title-heading-left fusion-responsive-typography-calculated\" style=\"margin:0;--fontSize:49;line-height:1.1;\"><h4>L&rsquo;inconscience des candidats<\/h4><\/h1><\/div><div class=\"fusion-text fusion-text-8\"><p style=\"text-align: justify;\">Il faut savoir que lorsqu\u2019ils \u00e9tablissent leur CV et\/ou rendent compte de leur parcours professionnel sur un r\u00e9seau social, les candidats m\u00e9sestiment souvent l\u2019importance de l\u2019exactitude de leurs donn\u00e9es dans une proc\u00e9dure de recrutement.<\/p>\n<\/div><div class=\"fusion-text fusion-text-9\"><p style=\"text-align: justify;\">Afin que cette inconscience ne soit pas confondue avec de la malhonn\u00eatet\u00e9, il peut \u00eatre recommand\u00e9 aux employeurs de faire valider l\u2019exactitude des donn\u00e9es d\u00e9cisives contenues dans les CV ou sur les r\u00e9seaux sociaux professionnels par les candidats eux-m\u00eames. Ce faisant, de nombreuses situations d\u00e9licates et erreurs de casting, bien souvent tr\u00e8s on\u00e9reuses, pourront \u00eatre \u00e9vit\u00e9es.
