Lors de cette \u00e9tape importante de la s\u00e9lection des candidats, un \u00e9change d\u2019informations et de donn\u00e9es personnelles a forc\u00e9ment lieu entre les diverses personnes de r\u00e9f\u00e9rence et les employeurs potentiels. A ce titre, la loi met certaines limites \u00e0 ladite collecte d\u2019informations afin de respecter les droits de la personnalit\u00e9 des candidats.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-1 sep-underline sep-solid fusion-title-text fusion-title-size-one\" style=\"--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:20px;--awb-margin-left-small:0px;\"><h1 class=\"fusion-title-heading title-heading-left fusion-responsive-typography-calculated\" style=\"margin:0;--fontSize:49;line-height:1.1;\"><h4>La protection des donn\u00e9es<\/h4><\/h1><\/div><div class=\"fusion-text fusion-text-2\"><p style=\"text-align: justify;\">En vertu des articles 328b Code des obligations (CO), 4 et 13 Loi sur la protection des donn\u00e9es (LPD), la prise de r\u00e9f\u00e9rence doit respecter une s\u00e9rie de principes s\u2019appliquant de mani\u00e8re g\u00e9n\u00e9rale \u00e0 la collecte de donn\u00e9es et d\u2019informations.<\/p>\n<\/div><div class=\"fusion-text fusion-text-3\"><p style=\"text-align: justify;\">Tout d\u2019abord, la prise de r\u00e9f\u00e9rence ne peut en aucun cas donner lieu \u00e0 des violations de normes l\u00e9gales, telle la collecte de donn\u00e9es en l\u2019absence du consentement des candidats ou d\u2019un int\u00e9r\u00eat pr\u00e9pond\u00e9rant de la part de l\u2019employeur potentiel. L\u2019int\u00e9r\u00eat pr\u00e9pond\u00e9rant est en g\u00e9n\u00e9ral pr\u00e9sent s\u2019il y a un r\u00e9el int\u00e9r\u00eat \u00e0 engager un candidat. L\u2019exigence de consentement n\u2019est par contre malheureusement pas toujours respect\u00e9e par le futur employeur. Un tel comportement de la part du futur employeur est non seulement ill\u00e9gal, comme on l\u2019a vu, mais il viole \u00e9galement le principe de la bonne foi, puisque les informations sont collect\u00e9es \u00e0 l\u2019insu du candidat.<\/p>\n<\/div><div class=\"fusion-text fusion-text-4\"><p style=\"text-align: justify;\">Ensuite, il est n\u00e9cessaire que la prise de r\u00e9f\u00e9rence soit faite dans le respect du principe de proportionnalit\u00e9. Il s\u2019agit ici de s\u2019assurer que les informations obtenues aupr\u00e8s des personnes de r\u00e9f\u00e9rence soient non seulement pertinentes en vue du poste vis\u00e9, mais qu\u2019en outre ces informations ne d\u00e9passent pas le strict n\u00e9cessaire au processus de recrutement. On peut donc demander \u00e0 la personne de r\u00e9f\u00e9rence si la qualit\u00e9 et la quantit\u00e9 du travail fourni \u00e9taient toujours satisfaisantes, mais non pas, par exemple, si un \u00e9v\u00e9nement dans la vie priv\u00e9e d\u2019un candidat a eu une influence n\u00e9gative sur sa performance.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-2 sep-underline sep-solid fusion-title-text fusion-title-size-one\" style=\"--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:20px;--awb-margin-left-small:0px;\"><h1 class=\"fusion-title-heading title-heading-left fusion-responsive-typography-calculated\" style=\"margin:0;--fontSize:49;line-height:1.1;\"><h4>La prise d&rsquo;informations pertinentes<\/h4><\/h1><\/div><div class=\"fusion-text fusion-text-5\"><p style=\"text-align: justify;\">Enfin, il est important selon l\u2019art. 4 al. 4 LPD que le but de la prise de r\u00e9f\u00e9rence soit reconnaissable pour le candidat. Il est \u00e9vident que la finalit\u00e9 de la collecte d\u2019information doit se limiter \u00e0 une meilleure compr\u00e9hension des comp\u00e9tences du candidat par le futur employeur. Il est donc interdit de se renseigner sur sa situation financi\u00e8re afin de n\u00e9gocier un salaire moins \u00e9lev\u00e9, ou encore de se renseigner sur l\u2019orientation sexuelle ou les pr\u00e9visions familiales du candidat pour en tirer une conclusion.<\/p>\n<\/div><div class=\"fusion-text fusion-text-6\"><p style=\"text-align: justify;\">Si dans le cadre de ce qui pr\u00e9c\u00e8de, une personne de r\u00e9f\u00e9rence r\u00e9v\u00e8le des informations non-pertinentes, elles ne peuvent avoir aucune port\u00e9e l\u00e9gitime sur l\u2019issue du processus de recrutement; en effet le candidat n\u2019aura certainement pas consenti \u00e0 la communication d\u2019une information d\u2019un tel degr\u00e9 d\u2019intimit\u00e9 \u00e0 son \u00e9gard, qui ne pr\u00e9sente de toute fa\u00e7on aucun int\u00e9r\u00eat pour le poste en question.<\/p>\n<\/div><div class=\"fusion-text fusion-text-7\"><p style=\"text-align: justify;\">A l\u2019issue de cette br\u00e8ve analyse du cadre l\u00e9gal de la prise de r\u00e9f\u00e9rence, il est important de constater que ce processus peut \u00eatre d\u00e9cisif quant \u00e0 la d\u00e9cision d\u2019une future collaboration. A cet \u00e9gard, il est donc fondamental pour le rapport de confiance entre futur employ\u00e9 et employeur que cette collecte soit effectu\u00e9e dans le respect des principes \u00e9num\u00e9r\u00e9s ci-dessus. Une prise de r\u00e9f\u00e9rence par une partie ind\u00e9pendante peut aider \u00e0 \u00e9viter certains pi\u00e8ges.<\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div><\/div><\/div><\/div><\/div><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-2 fusion-flex-container nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-margin-bottom:-60px;--awb-flex-wrap:wrap;\"
