donn\u00e9es concernant l\u2019employ\u00e9 dans la mesure \u00a0o\u00f9 ces donn\u00e9es sont li\u00e9es \u00e0 la capacit\u00e9 de l\u2019employ\u00e9 \u00e0 accomplir son travail ou sont n\u00e9cessaires \u00e0 l\u2019ex\u00e9cution du contrat de travail, et tant que la loi f\u00e9d\u00e9rale sur la protection des donn\u00e9es est respect\u00e9e. Il n\u2019y a donc pas lieu de douter de la l\u00e9galit\u00e9 de la pratique consistant \u00e0 v\u00e9rifier les ant\u00e9c\u00e9dents des candidats et des employ\u00e9s, surtout lorsqu\u2019il s\u2019agit de postes de confiance.<\/p>\n<p style=\"text-align: justify;\">La v\u00e9rification des r\u00e9f\u00e9rences aupr\u00e8s des pr\u00e9c\u00e9dents employeurs permettra de savoir si des proc\u00e9dures disciplinaires ont d\u00e9j\u00e0 \u00e9t\u00e9 engag\u00e9es \u00e0 l\u2019encontre de la personne concern\u00e9e ou de conna\u00eetre les v\u00e9ritables raisons de la fin de la collaboration afin de ne pas se limiter aux termes g\u00e9n\u00e9riques d\u2019un certificat de travail. Bien entendu, l\u2019autorisation pr\u00e9alable de la personne concern\u00e9e reste indispensable pour ces v\u00e9rifications.<\/p>\n<p style=\"text-align: justify;\">Plusieurs niveaux de v\u00e9rification sont possibles et envisageables. Ils ne doivent pas \u00eatre choisis en fonction du profil individuel de la personne, mais en fonction d\u2019un niveau de risque d\u00e9fini au pr\u00e9alable par les sp\u00e9cialistes des risques (humains). Ce niveau de risque permet d\u2019identifier clairement les postes sensibles au sein de l\u2019organisation en relation avec les risques strat\u00e9giques, par exemple en fonction des niveaux d\u2019acc\u00e8s et des responsabilit\u00e9s d\u00e9cisionnelles.
